| This Tire Road Hazard Program (“Program”) is offered by Discount Tire Zone and administered by
Sonsio Management, Inc. (“Program Administrator”). In the State of New York, Sonsio International Wisconsin, Inc. is the Program Administrator and Obligor of this Program. |
COVERAGE This Program provides for the repair or replacement of new or used tires and is limited to the repair or replacement of tires damaged by a road hazard. The Program commences on the date of purchase and extends for 36 months from the date of purchase of tires, or until 2/32” or less of tire tread remains, whichever occurs first. Original purchase of the program coverage is offered only in sets of four (4) tires. Single tire Program coverage may be purchased for replacement tires only. A Road Hazard Identification Number for each covered tire must be listed on your purchase invoice at the time of sale. Coverage is not transferable to any other vehicle or tires. |
WHAT IS ROAD HAZARD DAMAGE? Road hazard damage occurs when a tire fails during the
course of driving in a legal manner on a road maintained by state or local authority due to debris on the
road surface. Nails, glass and potholes are the most common examples of road hazards. |
FLAT TIRE REPAIR This Program covers for the cost of flat tire repair up to $20.00 per tire, per
occurrence. If a tire is damaged due to a covered road hazard and can be safely repaired per approved
industry methods and guidelines, the tire may be repaired at any participating dealer.
Coverage remains in effect for the repaired tire for the remaining coverage term, or until 2/32” or
less tread remains, whichever occurs first. Limit 2 flat tire repairs during the applicable term of the Program. |
FLAT TIRE CHANGING ASSISTANCE This Program provides for reimbursement up to $50.00 for flat tire changing assistance provided by a licensed service provider of your choice. Flat tire
changing assistance is strictly limited to the installation of your useable spare tire. You must have a useable spare tire. You are solely responsible for towing or other parts and services. This benefit applies only to motorized passenger vehicles and specifically excludes trailers. You may contact the Program Administrator for assistance in locating a licensed service provider. This service requires
use of a credit card to arrange for dispatch. Limit 1 flat tire changing assistance incident during the applicable term of the Program. |
TIRE REPLACEMENT This Program covers the costs to replace a covered tire damaged due to a road hazard with more than 2/32” tread remaining during the 36-month term of this Program, up to the
coverage limits selected. You are responsible for any additional charges including, but
not limited to, mounting, balancing, and taxes. The tire will be replaced if it can no longer hold air or
cannot be safely repaired per approved industry methods and guidelines. When a tire failure occurs in the first 12 months after the date of Program purchase, it will be replaced with coverage up to 100% of
the original purchase price of the tire or the replacement cost, or the selected Program benefit limit, whichever is
less. When a tire failure occurs in the second 12 months, it will be replaced with coverage up to 50%
of the original purchase price of the tire or the replacement cost, or the selected Program benefit limit, whichever
is less. When a tire failure occurs in the third 12 months, it will be replaced with coverage up to 25%
of the original purchase price of the tire or the replacement cost, or the selected Program benefit limit, whichever
is less. When a tire is worn down to 2/32” or less, the tire is considered worn out and is not eligible
for tire replacement benefits. NEW COVERAGE MAY BE PURCHASED FOR THE REPLACEMENT TIRE BY CALLING 1-800-659-3021.
If a tire needs to be replaced and authorization cannot immediately be obtained, the Customer may elect to wait for authorization or proceed with a tire replacement. In order to be eligible for reimbursement for a replacement claim, the damaged tire must be retained and the Program Administrator must be contacted within 48 hours. There is no guaranteed eligibility. |
LIMITS OF LIABILTY If Administrator determines that a covered tire is not repairable, it may be replaced with tires of like kind and quality replacement value. Administrator reserves the right to limit reimbursement to the generally accepted retail replacement cost. |
YOUR RESPONSIBILITIES

Properly care for and maintain your tires, including ensuring tires are operated at proper inflation pressures. |

2. |
Use all reasonable means to protect your vehicle from additional damage. |
| |
3. |
Contact the Administrator at 866-608-9825 for instructions and a confirmation number before work is commenced. |
| |
4. |
Furnish such information as may be required. |
| |
5. |
Incur only expenses which are authorized in advance. |
| |
6. |
Payment of all expenses and costs not covered by this Program. |

CLAIMS PROCEDURE

1. |
For flat tire changing assistance reimbursement, submit a copy of your original invoice (with Road Hazard Identification Numbers) and a copy of the paid invoice from a licensed service provider. The invoice must include
the service provider’s name, address and telephone number and the year, make and model of your vehicle. Submit claims to: Flat Tire Change Reimbursement, P.O. Box 17599, Golden, CO 80402. |

For repair or replacement claims, the dealer will verify the coverage term is applicable based on the date on the original purchase invoice and that the damaged tire has more than 2/32” tread remaining. |

If the dealer determines that the tire is repairable, the tire will be repaired as described under Flat Tire Repair. If the dealer determines that the tire cannot be repaired, the tire will be replaced as
described under Tire Replacement. |

4. |
For tire replacement, contact the Administrator at 866-608-9825 for instructions and a confirmation number before work is commenced. |
| |
5. |
For repair and replacement claims, you must present the dealer with your original purchase invoice (with Road Hazard Identification Numbers) and the repair/replacement invoice signed by you. The dealer will make a copy of the original invoice and the repair/replacement invoice and return the original invoices to you. |

6. |
You must provide the Program Administrator with the Department of Transportation ("DOT") numbers on the damaged tire. |
| |
7. |
Repair and replacement claims must be submitted to the Program Administrator, Tire Road Hazard Program, P.O. Box 17480, Golden, CO 80402. |
| |
8. |
You are responsible for all expenses and costs not covered by this Program. |
| |
9. |
For paid tire replacement claims, the corresponding Road Hazard Identification Number will no longer be valid. |
| |
10. |
Tires that require replacement must be made available for inspection. |
| |
11. |
Tires being replaced must be surrendered to the servicing dealer. |
| |
12. |
ALL CLAIMS DOCUMENTATION MUST BE RECEIVED BY ADMINISTRATOR
(INCLUDING THE TIRE IF REQUESTED) WITHIN SIXTY (60) DAYS OF SERVICE, OR THE CLAIM MAY BE DENIED. |

The issuance of a confirmation number does not imply the Administrator has approved a claim, only that the Program Holder has fulfilled their responsibility in reporting such claim.

THE PROGRAM ADMINISTRATOR RESERVES THE RIGHT TO DENY ANY CLAIM SUBMITTED WITH FALSE OR MISLEADING INFORMATION OR IF THE PAPERWORK DOES NOT CLEARLY IDENTIFY THE ORIGINAL PURCHASER, VEHICLE AND TIRES.

EXCLUSIONS: THIS PROGRAM WILL NOT PAY OR REIMBURSE FOR:

REPLACEMENTS MADE WITHOUT ADMINISTRATOR AUTHORIZATION. |

2. |
REPAIRS MADE BY ANYONE OTHER THAN AN AUTHORIZED SERVICE PROVIDER, ITS AGENTS, CONTRACTORS OR LICENSEES. |

3. |
FAILURE OCCURRING WHEN THE TREAD DEPTH IS 2/32” OR LESS. |
| |
4. |
TIRES WHICH ARE NOT RECOMMENDED BY THE MANUFACTURER. |
| |
5. |
COSMETIC DAMAGE, I.E. DAMAGE THAT DOES NOT AFFECT THE STRUCTURAL INTEGRITY OR SAFETY OF THE TIRE. |

6. |
DAMAGE TO TIRES IN EITHER THE SIDE WALL OR TREAD AREA DUE TO DRY ROT. |
| |
7. |
DAMAGE INCURRED OUTSIDE THE UNITED STATES AND CANADA. |
| |
8. |
LOSS, DAMAGE OR EXPENSE CAUSED BY ACCIDENTS, COLLISION, THEFT, SNOW CHAINS, EXPLOSION, LIGHTNING, EARTHQUAKES, FIRE, WINDSTORMS, WATER, FLOODS, MALICIOUS MISCHIEF, VANDALISM, CIVIL COMMOTION, RIOTS, WAR. |

THE REPAIR OR REPLACEMENT DUE TO MANUFACTURER RECALL, DEFECT OR WARRANTY OR ANY REASON THE MANUFACTURER WILL REPAIR OR REPLACE AT ITS EXPENSE OR AT A REDUCED COST. |

PERSONAL EXPENSES ARISING BECAUSE YOUR VEHICLE IS NOT AVAILABLE FOR USE, INCLUDING STORAGE OR FREIGHT CHARGES. |

TRAFFIC FINES, CITATIONS OR PENALTIES. |

23. |
LIABILITY FOR DAMAGE TO PROPERTY, INJURY TO OR DEATH OF ANY PERSON ARISING OUT OF THE OPERATION, MAINTENANCE OR USE OF YOUR VEHICLE WHETHER OR NOT RELATED TO TIRE DAMAGE. |

This Program gives you specific legal rights; you may have other rights, which vary from state to state. Some states do not allow the exclusion or limitation of consequential or incidental damages, therefore
such limitations may not apply to you.

GENERAL
| |
1. |
The terms and conditions outlined herein are the full and complete agreement between the parties. No oral representations should be relied upon, including any oral statements of the selling or repairing dealer. |
| |
2. |
The Administrator may delegate the performance of its duties and obligations and assign its rights and benefits hereunder. |
| |
3. |
Administrator assumes no obligation or responsibility with regard to the vehicle. |
| |
4. |
Administrator neither assumes, nor authorizes, anyone to assume additional liability on its behalf. |
| |
5. |
If Administrator makes any payment under this Program and you have a right to recover against another party, your rights shall become our rights and you shall do whatever is necessary to enable Administrator to enforce these rights. |

CANCELLATION The Program Administrator reserves the right to cancel this Program by refunding the original purchase price to the purchaser. You may cancel this Program by contacting Discount Tire Zone to request a refund within 20 business days for a full refund of the amount paid for the Program. Cancellation requests may be made by submitting a CONTACT FORM and indicating your desire to discontinue Road Hazard Program coverage in the general comments field. A 10% penalty per month will be applied to any refund that is not paid or credited within 30 days after contacting Discount Tire Zone to request cancellation of the Program. The Program Administrator reserves the right to cancel this Program by refunding the original purchase price to the purchaser. If we cancel for any reason other than 1) nonpayment of the program price; 2) material misrepresentation; or 3) substantial breach of duties by you, Program Administrator will provide written notice of cancellation at least 15 days prior to the effective date of cancellation. |
TRANSFER This Program is extended only the original purchaser of the tire(s) and may not be transferred to anyone who purchases your vehicle or tires during the term of this Program. |
DISCLAIMER YOU ARE NOT REQUIRED TO PURCHASE THIS PROGRAM AS A CONDITION TO THE PURCHASE OF ANY PRODUCT OR AS A CONDITION TO THE EXTENSION OF CREDIT. |
